Athlete Agreement – Under 18

This Athlete Profile Agreement (“Agreement”) is entered into between Club Sports Finder, LLC (“Company,” ‘we,” or “our”) and the parent or guardian (“Parent/Guardian,” “you,” or “your”) of the minor athlete for whom a profile is created pursuant to this Agreement (“your Athlete”). By allowing your Athlete to create a profile pursuant to this Agreement (a “Profile”), you agree to the terms below and provide consent for your Athlete to create a Profile.

1. Purpose and Use of Platform.

1.1 Purpose of Website.  Our website, mobile application, and related services (collectively, our “Platform”) allows athletes to create a Profile to share information regarding themselves and their athletic experience (see details below for what information can be included in the different profile levels: Free, Standard, and Premium). The information your Athlete chooses to include in their Profile will be displayed publicly on our Platform. Optional contact information for you (i.e., phone, and email) will not be displayed publicly, but will be available to club sport organizations that have Premium Profiles on our Platform.

Our Platform is a venue only and we are not a party to any agreements or interactions that may occur between you and/or your Athlete and an Allied Professional, Club Sport Organization or any other user of our Platform.

 

1.2 Use of our Platform.  You agree that you and your Athlete will use our Platform in accordance with, and subject to the limitations and restrictions set forth in our Terms of Use and other policies, guidelines and subscriptions found here, (collectively, the “Platform Agreement”). the provisions of which are incorporated herein by reference.

2. Athlete Code of Conduct.

You and your Athlete agree to:

  • Treat all users, coaches, and officials with respect;
  • Avoid bullying or inappropriate behavior;
  • Submit only truthful, sports-related content;
  • Follow online safety practices and not disclose sensitive personal information; and
  • Comply with any team, club, or governing body rules
3. Eligibility.

3.1 Permission Required.  Your Athlete may only create a Profile under the terms of this Athlete Profile Agreement with your permission.

3.2 Parent/Guardian Consent.  Before your Athlete may submit information for a Profile, you will be required to provide the consent as outlined below.

3.3 Prohibition on Participation.  If your Athlete is under the age of 13 years old, they will not be permitted to create a Profile or use our Platform.

4. Disclaimer and Limitation of Liability; Indemnification.

In addition to the disclaimers, limitations on liability and indemnities set forth in the Platform Agreement, you agree as follows:

4.1 No Endorsement.  We do not endorse, guarantee, or make any representations regarding the quality, safety, or suitability of any Allied Resource Professional, Club Sport Organization or any other user of our website We have not verified the background, qualifications, or credentials beyond the information provided by any person or entity.

4.2 Assumption of Risk.  Your use or your Athlete’s use of our Platform and engagement with any Allied Professional, Club Sport Organization or any other user of our website is at your own risk.

4.3 Limitation of Liability.   We will not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use of our website or any interactions between you or your Athlete and any Allied Professional, Club Sport Organization or any other user of our Platform, even if we have been advised of the possibility of such damages.

4.4 Indemnification.  You agree to indemnify, defend, and hold harmless the Company, its affiliates, officers, directors, employees, and agents from any and all claims, liabilities, damages, losses, and expenses (including attorneys’ fees) arising out of or in any way connected with:

  • Your acceptance or your Athlete’s acceptance of services or products from Allied Professionals, Club Sports Organizations or any other third parties;
  • Your Athlete’s Profile;
  • Your breach of this Agreement or the Platform Agreement or your Athlete’s breach of this Agreement or the Platform Agreement; or
  • Your interactions or your Athlete’s interactions with any Allied Professional, Club Sport Organization or any other user of our website.

The provisions set forth in this Section 4 shall survive the termination of this Agreement.

5. Parental Consent.

You must identify yourself and give permission for your Athlete to create a Profile.  You are responsible for what information is included in your Athlete’s Profile.  This consent is given through the profile creation process. By the submission of  your Athlete’s profile, you confirm the following:

  • You are the parent or legal guardian of such Athlete.
  • You have read and understand this Athlete Profile Agreement and the Platform Agreement including the Privacy Policy and Youth Safety Policy;
  • You give permission for your Athlete to create a Profile on our Platform, including sharing their personal and athletic information. You understand that this information will be publicly viewable on our Platform;
  • You understand that your contact information (i.e., phone and email) will not be publicly displayed on your Athlete’s Profile but will be accessible to Sports Club Organizations that have Premium Profiles on our Platform;
  • You accept responsibility for ensuring your Athlete complies with this Athlete Profile Agreement and the Platform Agreement; and
  • You may request the removal of your Athlete’s profile at any time by contacting support@clubsportsfinder.com or through your account settings.
6. Parent/Guardian Responsibilities and Representations.  You agree to:
  • Monitor my Athlete’s Platform activity;
  • Ensure your and your Athlete’s submissions are accurate, lawful, and appropriate;
  • Report any safety, privacy, or policy concerns promptly;
  • Ensure uploaded content and information submitted by you or your Athlete does not infringe copyright or violate law; and
  • Release the Company from liability for inaccurate or improper content or information submitted by you or your Athlete.
7. Privacy and Use of Personal Information.

We will use the personal information provided by or on behalf of your Athlete pursuant to this Agreement solely for the purpose of displaying your Athlete Profile on our Platform or as otherwise set forth in our Privacy Policy Policy (which is included in the Platform Agreement),which describes how we collect, use and protect information.

 

8. Profile Level Details and Cost.

The table below outlines the information that can be included in your Athlete’s Profile and the cost of each of our Athlete Membership Levels: Free, Standard, and Premium.

9. Profile Fee, Payment, Non-Payment  (For Standard and Premium Profiles).

9.1 Profile Levels.  Standard and Premium Profiles require payment of $9.99 per month or $100 annually (Standard Profile) and $19.99 per month or $200 annually (Premium Profile).

9.2 Payment.  Payment will be collected automatically via the credit card you provide at signup.

For the monthly payment option:

  • Payments will recur on a monthly basis unless and until this Agreement is terminated.
  • By providing your payment information, you authorize us to charge your card each month until this Agreement is terminated.

For the annual payment option:

  • Payments will recur on an annual basis unless and until this Agreement is terminated prior to your renewal date.
  • By providing your payment information, you authorize us to charge your card annually until the termination of this Agreement.

9.3 Non-Payment & Suspension.

  • Failure to Process.  If payment cannot be processed, you will be notified and given an opportunity to update your payment method.
  • Removable of Profile.  If payment remains unpaid for 30 days, your Athlete’s Profile will be removed from the Platform and this Agreement shall terminate.
  • Reinstatement.  Reinstatement requires payment of the profile fee and reactivation of your account.

 

10. Termination.

10.1 Termination by You.  You may cancel your Athlete’s profile and terminate this Agreement at any time by contacting support@clubsportsfinder.com or through your account settings.

10.2 Termination by Company.  In addition to any rights and remedies the Company may have under the Platform Agreement, at law or in equity, if the Company determines in its sole judgement that you or your Athlete have violated this Agreement, the Platform Agreement, or applicable law, have threatened the safety of any user, have violated the integrity of our Platform, or your acts or omissions or the acts or omissions of your Athlete may result in any of the foregoing, then the Company may in its sole discretion and without notice, terminate this Agreement and take down your Athlete’s Profile.

10.3 No Refunds.  No refunds will be issued for partial months or years.

 

11. Amendment of Agreement.

11.1 Amendments.  The Company reserves the right, in its sole discretion, to modify, amend, or update this Agreement from time to time. Except as expressly permitted below, any amendments will apply prospectively only.

11.2 Notice of Changes.  The Company will provide reasonable advance notice of any material changes to this Agreement, which may be provided by posting the revised Agreement on our Platform, by email to the address associated with your account, through an in-account notification, or by other reasonable means. The effective date of the amended Agreement will be stated in the notice.

11.3 Non-Material Changes.  Non-material changes (including clarifications, formatting changes, or updates that do not materially affect your rights or obligations) will be effective upon posting.

11.4 Material Changes.  Material changes—including changes affecting profile fees, billing practices, core features or benefits of a paid profile, dispute resolution provisions, or data use practices (some of which may set out in the Platform Agreement)—will become effective no earlier than 30 days after notice is provided and will apply only on a going-forward basis. If you do not agree to a material change, you may terminate the Agreement prior to the effective date of the change in accordance with the termination procedures set forth herein.

11.5 Fees and Billing.  Unless you affirmatively agree otherwise, changes to profile fees or billing terms will apply only at the start of your next renewal period. The Company will not increase fees or materially reduce paid benefits during a prepaid profit term without your express consent.

11.6 Acceptance of Amended Agreement.  Continued use of our Platform after the effective date of an amendment constitutes acceptance of the amended Agreement, except where applicable law or this Agreement require affirmative acceptance.

11.7 Renewed Consent.  Material amendments will not become effective unless and until you provide renewed consent, as required by the Platform’s policies and applicable law.  Until such renewed consent is given your Athlete’s Profile will be suspended.
