Purpose.
Club Sports Finder (the “Company,” “we” and “our”) is committed to promoting a safe and positive environment for minor athletes using this website, mobile application, and related services (collectively, our “Platform”).
This Policy is part of our Platform’s Terms of Use and the other policies and guidelines referenced therein (collectively, together with this Policy, the “Platform Agreement”) and is designed to protect minors, mitigate risk, and comply with applicable youth-protection laws.
Acknowledgment.
By creating an account, logging in, or using our Platform in any capacity you agree to the following:
- You have read, understood, and agree to comply with this Policy.
- You acknowledge that your compliance is a condition of access to and use of our Platform.
- You understand that violations of this Policy may result in account suspension, restriction, or termination.
- For Parents and Legal Guardians: You provide consent for your minor to use our Platform under this Policy.
Platform Monitoring Disclaimer.
Our Platform provides tools and mechanisms to promote minor safety; however, the Company does not have any obligation to monitor, police, or proactively review all communications, content, or user activity for compliance with this Policy. Adult users including parents and guardians acknowledge that our Platform relies on user reporting and parental/guardian oversight to enforce this Policy, and that the Company’s lack of proactive monitoring does not constitute approval of any content or activity.
No Supervisory or Fiduciary Role.
The Company does not supervise or control athletic instruction, does not act in loco parentis, and is not responsible for the conduct of users outside our Platform.
Scope.
This policy applies to:
- All users under the age of 18 (“Minor Athletes”);
- All adult users including but not limited to those who offer coaching, training, instruction, mentoring, evaluation, recruitment, or other sports-related guidance or services to Minor Athletes such as strength and conditioning coaches, personal trainers, private coaches, sports psychologists, mental skill trainers, physical therapists, sport massage providers, chiropractors, nutritionists, and wellness coaches (collectively, “Allied Professionals”); and
- All content, communications, and interactions that occur on or via our Platform;
General Youth Protection Rules.
- Age Eligibility. Only users 13 and older may use our Platform.
- Parental Oversight. Parents or guardians should actively supervise their Minor Athletes and have access to communication and account information.
- Appropriate Content. Content visible to or involving Minor Athletes must be age-appropriate and free from sexual, violent, or harmful material.
- Prohibited Conduct. Bullying, harassment, sexualized communications, requests for personal information unrelated to sports, and attempts to isolate Minor Athletes are strictly prohibited.
- Data Minimization. Our Platform limits the collection and use of personal information from Minor Athletes to what is reasonably necessary to provide Platform functionality. Minor Athletes are not required to disclose unnecessary personal information to participate.
Adult User Rules.
- Verification. All Allied Professionals must represent that they are eligible to work with minors and may be subject to verification or background screening.
- Controlled Communication. All communications with Minor Athletes must occur through Platform-approved tools subject to monitoring.
- Two-Deep Communication Rule. Direct one-to-one communication with Minor Athletes requires a parent/guardian copied in communications or oversight through Platform tools.
- Media Guidelines. Sharing images or video of Minor Athletes requires consent by their parents/guardians and must be non-sexualized and related to sports participation.
- In-Person Meetings. Our Platform shall not be used to arrange unsupervised in-person meetings with Minor Athletes; all meetings require parental/guardian explicit consent.
Mandatory Reporting.
- Mandatory Reporters. Users who are considered mandatory reporters under applicable law (e.g., certain coaches, teachers, healthcare providers) must report suspected abuse, neglect, or sexual misconduct involving a Minor Athlete to the appropriate law enforcement or child protection authorities.
- Internal Reporting. All adult users, regardless of mandatory reporter status, must report suspected abuse, neglect, grooming, or sexual misconduct to us using the provided reporting mechanisms.
- Legal Compliance. Reporting to us does not satisfy any legal obligations for mandatory reporters. Mandatory reporters remain responsible for complying with all applicable laws.
- Encouragement for Non-Mandatory Reporters. While not legally required, non-mandatory reporters are strongly encouraged to contact authorities if they reasonably suspect criminal activity involving a Minor Athlete.
- Cooperation. All users must cooperate with our investigation or lawful inquiry relating to youth safety or suspected misconduct.
Parental Rights and Access.
- Parental Access. Parents or guardians may access, review, correct, or request removal of their Minor Athlete’s personal information.
- Review of Information. Parents should review all communications and media involving their Minor Athlete.
Rights and Remedies.
In addition to the rights and remedies set forth in other sections of the Platform Agreement and in no way in limitation of any other rights and remedies at law or in equity, the Company shall have the rights and remedies set forth below.
- Suspensions, Etc. Violations of this Policy may result in suspension, restriction, or termination of accounts.
- Reporting to Authorities. Serious violations, including abuse or exploitation, to the extent known by us, will be reported to authorities immediately.
- Removal of Content. The Company reserves the right to remove or restrict content and communications to ensure safety of a Minor Athlete.
Special Rules for California.
The following provisions apply to users who are residents of California or whose interactions involve Minor Athletes located in California.
- California Minor Privacy Rights (Eraser Law). Pursuant to California Business and Professions Code Section 22581, California users under eighteen (18) years of age may request removal of content they have publicly posted. The Company will comply as required by law, subject to limitations for reposted, archived, or legally required content.
- Heightened Data Restrictions. The Company does not sell the personal information of California Minor Athletes and does not knowingly use such information for targeted advertising beyond what is permitted by law.
- Parental Rights. Parents/guardians of California Minor Athletes may request access to, correction of, or deletion of their child’s personal information, subject to verification.
- Mandatory Two-Deep Rule for California. For interactions involving a California Minor Athlete, the two-deep communication rule is mandatory and non-waivable. Any violation constitutes grounds for immediate enforcement action.
